GENERAL TERMS FOR PARTICIPATION IN CONTEST "Social Issues" 1. Subject 1.1. These General Terms (hereinafter referred to as the GENERAL TERMS) for participation in the contest "Social Issues" (hereinafter referred to as the Contest) settle the terms and conditions for participation in the Contest for choosing the best photography introducing any social issue related theme. 1.2. The Contest is conducted in order to find the User uploaded the MEDIA file with the most valuable social issue photography and to reward the winners of the contest 1.3. The GENERAL TERMS constitute a contract between the Organizer and each Participant who has submitted an application for participation in the Contest in the manner described in below. For the avoidance of any doubt, these GENERAL TERMS are binding for each Participant from the time of the application and entry in the Contest 2. Organizer of the Contest (ORGANIZER) ORGANIZER of the CONTEST is Famozzo Group LLC - VAT - BG203171695, registered in Bulgaria, Sofia, bul. Vasil Levski 123 3. All participants in the Contest, who do not win awards, shall preserve the copy rights on their photos. VOUBS shall not resell or cede their copyrights to third parties. 5.1. First round 5.1.1. The First round of the Contest shall be conducted in the period from 00:00 h on 08.12.2015 to 23:59 on 06.02.2016 5.1.2. Within the First round all Participants shall sent an appropriate media related to the topic of the contest; 5.1.3. The participants shall register in the page of the Contest "Social Issues" at http://www.voubs.com 5.1.4. The participants are required to submit their real names, telephone number and e-mail for contact in their VOUBS profile. If a participant has not submitted or refuses to submit his/her name, telephone number and e-mail for contact, he/she may be disqualified. 5.1.5. With uploading the media file the participants shall submit a header and brief description about their entry. 5.1.6. The total score results will be visible for the last 20 days of conducting the Contest in the internet page of the contest "Social Issues" at http://www.voubs.com, and the winners will be notified by the e-mail or telephone number they have submitted or by personal message to their voubs profile. 5.1.7. The total score result and the rankings are updated minimum 3 times per day. 5.1.8. The highest ranked 50 participants will qualify for the 2nd round - Jury Vote. 5.1.9 There will be 1 winner after the 1st round. 5.2. Second round 5.2.1. The Second round of the Contest shall be conducted in the period from 00:00 h on 07.02.2016 to 23:59 on 10.02.2016 . 5.2.2. A team of 8 jury members will vote for their favourite participants with ratings from 1 to 10. 5.2.3. Each jury voting point will add 100 points to the total score of the participants. Respectively 1 = 100 points, 10 = 1000 points. 5.2.4. Each jury member will vote maximum once per entry. The jury may decide to vote only for his favourites and leave some medias without any votes. 5.2.5. The jury will vote for the first 50 partiicpants qualified with the highest total score results from the 1st round. 5.2.6. Points from the 1st round will not be valid for the 2nd round and all qualified participants will start with 0 points in the second round. 6. Awards 6.1. The Organizer grants a total of 4 cash awards: 1st round winner - 150 Euro; 2nd round winners - 300 Euro for 1st place, 200 Euro for 2nd place, 100 Euro for 3rd place. From 4th to 10th place ranked in the 2nd round every participant will receive encouriging 20 "WINGS" award. 6.2. The awards are non-transferable to third parties. 6.3. The Organizer is not allowed to change the nature and amount of the awards without notifying the Participants. 6.4. The manner of receiving the awards under p. 6.1. will be further agreed between the Organizer and the Participants having won the Contest. 6.5. All transaction fees, taxes or any other costs that may appear for the transfer shall be borne by the user. 6.6. The winners must provide the Organisator with their personal bank accounts and personal identificational document (passport, ID card or driving license). 6.7. The participant may decide that he/she does not want to receive his award. In that case the Organisator will offer his award to the next ranked participant. If he/she refuses the award too the Organisator will decide weather to continue with the next ranked participant or not to give the award to anybody. 6.8. If the participant do not provide the Organisator with details mentioned in p. 6.5 within 14 days, the Organisator will offer the award to the next ranked participant. 6.9. Every participant is allowed to win no more than one award from this contest. If he/she has more than one image among the winners, the best placed media will be allowed to claim for its award. 6.10 Relatives are not allowed to win more than one award from this contest. If there are two relatives among the winners the higher placed contestant will have the chance to apply for the award.winners the higher placed contestant will have the chance to apply for the award. 7. Rights and obligations of the Organizer and Participants 7.1. For the purpose of participating in the Contest the Participants shall submit a completely new material – media files created specifically for the Contest. 7.2. By entering the Contest, the Participants understand and agree that upon receipt of an award their names and media/s could be used in audio, print and video materials by the Organizer, for which the Organizer does not owe any payment. 7.3. The Participants agree the Organizer or authorized by him persons to communicate with them through phone calls, e-mail and SMS messages during the Contest and for a period of three months thereafter. The access to personal data of the Participants serves to establish contact therewith. 7.4. The Participant is personally liable for the correctness of the data submitted during the Contest. The provided information will be used for the purposes of the Contest and may be disclosed to third parties. 7.5. The Organizer is not liable for MEDIA files which have been lost. 7.6. The Organizer reserves the right to suspend or terminate the Contest or to amend the GENERAL TERMS at any time, for any valid technical or commercial reason. 7.7. The Organizer has the right to disqualify any applicant who does not meet the requirements to the Participants and their MEDIA files and Projects, indicated in these GENERAL TERMS, even in case the application of the Participant has been presented on the VOUBS Contest page. 8. Intellectual Property Rights 8.1. The Participants undertake until the determination of the winner of the Contest not to transfer and make available to third parties copyrights over the MEDIA files, arising under the Law on Copyright and Related Rights. 8.2. By accepting these GENERAL TERMS, each Participant agrees that with him being determined as an award winner from the Contest, all copyrights over the MEDIA files, arising under the Law on Copyright and Related Rights, remain a property of the Organizer, 8.3. The Participant reserves the right to change and alter the provided MEDIA files. 8.4. With presenting the MEDIA files, the Participant declares that he is the sole author of the latter and that the MEDIA file is his original work. The Participant declares that he is the sole holder of the copyright and that the latter does not include trademarks or other intellectual property rights of a third individual or corporation. 8.5. By applying to participate in the Contest the Participants declare that they have accepted these GENERAL TERMS. 8.6. The participant shall indemnify the Organizer: 8.6.1. At any claims by third parties relating to the rights and use of the MEDIA files, provided to the Organizer, under these GENERAL TERMS as well as in case of damages incurred to the Organizer as a result of the acquisition and use of the PHOTOS. 8.6.2. The Participant shall indemnify the Organizer and all third parties for all damages and lost benefits, including paid fines, for all costs and paid legal fees, that have occurred as a result of claims by and/or compensations paid to third parties in connection with his participation in the Contest in violation of the applicable law and these GENERAL TERMS. 9. Limitation of Liability 9.1. By accepting these GENERAL TERMS the Participant declares that his participation in the Contest is entirely at his own risk and responsibility. The Organizer shall not be liable for any damage caused to the Participant in participation in the Contest, unless they are caused intentionally. The Organizer shall not be liable for the type, nature and content of the sent by the Participants media files, information and materials. The Organizer is entitled to remove from participation MEDIA files of a Participant the content of which contradicts a legal act, the morality and/or decency. 9.2. The Organizer shall not be liable for failure to provide participation in the Contest under circumstances beyond his control - cases of force majeure, fortuitous events, problems in the global Internet network and other unforeseeable circumstances beyond the control of the Organizer. 10. Limitations 10.1. The Organizer has the right to immediately and without notice suspend, or limit the participation of a Participant and remove from participation a Participant when the latter acts contrary to law, these GENERAL TERMS, morality and decency. 10.2. In the above cases the Organizer shall not be liable for any damages and lost profits of the Participant or third parties that have occurred as a result from limiting the participation of a Participant in the Contest. 10.3. Where there is enough reason to assume that the act of the Participant could constitute a criminal offense, the Organizer shall refer the matter to the competent state authorities, providing all necessary information and materials that would help identifying the perpetrator and prove the committed crime. 10.4. In the circumstances under the previous article, in case to a Participant a limitation has been imposed – suspension, limitation of the participation or removal of the published MEDIA files, the restriction shall continue to be in effect until clarifying the facts of the case. 11. Supplementary provisions 11.1. Questions regarding the Contest can be addressed to the following e-mail address: email@example.com or through "Contact us" page at www.voubs.com 11.2 These GENERAL TERMS are available on the page of the contest "Social Issues" at http://www.voubs.com for the duration of the Contest. 11.3. By participating in this Contest, the Participants are bound by these GENERAL TERMS and undertake to comply with them. 11.4. By participating in the Contest, all Participants agree that the Organizer is entitled to use their materials for his own advertising purposes. Any materials involved in competitions can not be deleted unless the Organizer decides to do so. 11.5. In order to receive his/her award, the Winner must be verified. This is done by sending a personal identification document and a personal bank account number. Awards can be sent only to the person who is an award winner in the Contest. If the person of age is under 18 years, he/she is required to present a parent/guardian to receive the amount of the award. The Winner must indicate a bank account to which the amount of the award to be paid. The amount of the award shall be paid within 14 working days after VOUBS obtains the necessary information about the user. All fees, deductions and taxes that may result from the transfer of the amount shall be borne by the user. - Winners are the only ones entitled to sell the copyrights over their MEDIA files and the latter become the property of VOUBS, automatically after the payment of the award amount. By participating in the contest the user guarantees that he/she is aware of the terms and conditions and is not entitled to refuse the award after signing up for the Contest. - Media files which do not fit the theme of the Contest will not be allowed to it. - Media files being disputed over copyright may be disqualified. - Users who rely on fraudulent votes will be disqualified. Fraudulent votes means an organized group of unreal (unverified) users. In case VOUBS suspects fraud participating users may be blocked forever. - If we cannot reach the user who is an award winner upto 14 days after the contest ends and after more than 3 e-mails sent the Organisator may decide to give the award to the next qialified participant. 12. Disqualification may appear if: 12.1. The participant is using more than one account 12.2. The participant has submited a MEDIA file that is not on the theme of the contest 12.3. The participant is trying to cheat with fraudulent votes 12.4. The participant is not using his/her real names and personal details 12.5. The participant has submitted similar MEDIA files more than once 12.6. The participant has submitted a MEDIA file with copyrights of a third party These GENERAL TERMS shall enter into force on 08.12.2015.
